Application of This Policy

This privacy policy applies to all personal information collected by Powers Realty in connection with the services we provide and should be read alongside the terms of your Agreement with us. Where there is any inconsistency, the Agreement takes precedence.

By engaging our services or supplying us with your personal information, you agree to the collection, use, and handling of your data as outlined in this policy.

We may update this policy periodically to reflect legal or operational changes. The latest version will always be available on our website.

Why We Collect Your Personal Information

We may collect personal information about you and anyone representing you for the following purposes:

  • Facilitating real estate transactions (residential, lifestyle, rural, or commercial), including recording property inspections, expressions of interest, chattels, and valuations.
  • Promoting current or future listings through marketing, advertising, and social media campaigns.
  • Communicating with you about property news, market trends, updates, and events.
  • Sending direct marketing communications by email, phone, SMS, mail, or other means. You can opt out of receiving these communications at any time.
  • Conducting surveys and market research to better understand client needs and improve our services.
  • Analysing sales and website activity to enhance our digital presence and client experience.
  • Managing internal operations, including staff training and service delivery improvements.
  • Meeting our legal obligations under New Zealand law, such as the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT Act), Real Estate Agents Act 2008, tax laws, or regulatory requirements.
  • Assessing creditworthiness, invoicing for services, and pursuing unpaid accounts (which may involve debt collection agencies).
  • Any other purpose directly related to our business, which we notify you of or you authorise.

How We Collect Your Personal Information

We may collect information directly from you or from someone authorised to act on your behalf — such as when you contact us, complete a form, or attend a property inspection.

We may also gather information indirectly, including from public sources, credit reporting agencies, verification services, and via digital tools on our website and social media platforms.

We use cookies and similar technologies to:

  • Analyse site traffic and user behaviour.
  • Personalise content and digital advertising.

You can manage cookie preferences through your browser settings, though some features of our site may not function fully without them.

We may also use services such as Google Analytics or Meta Pixel for aggregated data collection, and you may see our ads on third-party platforms based on your browsing history.

Retention and Security of Your Information

We retain personal information only as long as necessary to fulfil the purpose for which it was collected, or as required by law.

We take reasonable steps to protect your personal information from loss, unauthorised access, misuse, or disclosure. Access to your information is restricted to staff and third parties who require it to perform services on our behalf.

Accessing and Correcting Your Personal Information

You have the right under the Privacy Act to access and correct any personal information we hold about you.

If you would like to request access or make a correction, please contact us. We will respond within a reasonable timeframe and may charge a modest fee to cover administrative costs, if applicable.

In cases where we cannot grant access or make a change (e.g., if it affects another person’s privacy), we will explain why and document your request.

Disclosing Your Information

We may disclose your personal information to:

  • Powers Realty staff or affiliated agents.
  • Professional advisers (such as lawyers or accountants).
  • Credit reporting or debt collection agencies.

  • Any party with your authorisation or as outlined in your Agreement.

We will never sell your personal information or use it for purposes outside of those described in this policy without your consent.

Overseas Disclosure

Some of the service providers we use may be located outside of New Zealand. Where this occurs, we ensure that your personal information is handled in accordance with the Privacy Act and any applicable local laws to maintain its protection.
